1. About LITAVHA
LITAVHA is a trading brand of DASLEY SENTINEL SERVICES (PTY) LTD, registration number 2026/636321/07. LITAVHA operates an online retail platform through which products may be offered for sale to customers in South Africa.
References in these Terms to “LITAVHA”, “we”, “us” or “our” refer to DASLEY SENTINEL SERVICES (PTY) LTD and the LITAVHA trading operation, as applicable. References to “you”, “customer” or “your” mean the person using the website or purchasing products.
2. Website use
You may use the website for lawful shopping, browsing and other purposes made available by LITAVHA. You must not use the website in a way that violates applicable law, infringes another person's rights, interferes with the operation or security of the website, or attempts to gain unauthorised access to systems, accounts or data.
You must not copy, reproduce, scrape, systematically extract, republish, commercially exploit or otherwise misuse substantial parts of the website, product catalogue, content, pricing data or other materials without written permission, except where such use is permitted by law.
3. Accounts and security
Certain features may require information that allows us to identify or communicate with you. You are responsible for ensuring that information supplied to LITAVHA is accurate and current. Where an account, password or other authentication method is used, you must take reasonable steps to keep it secure and must notify us if you believe it has been compromised.
We may restrict, suspend or close an account where reasonably necessary for security, fraud prevention, legal compliance, misuse of the service or other legitimate operational reasons, subject always to applicable consumer rights and law.
4. Electronic communications
When you use LITAVHA, submit forms, place an order, send an email or communicate with us electronically, you consent to receiving relevant electronic communications, including order confirmations, invoices, delivery updates, service notices and customer-support responses.
Electronic records may be used to evidence transactions and communications, subject to applicable law. You should keep copies of important order confirmations, invoices and policy documents supplied to you.
5. Products and product information
We make reasonable efforts to display product names, photographs, specifications, brands, prices, availability and other information accurately. Images may be illustrative and colours or appearance may vary between screens, lighting conditions and actual products.
Product information may be supplied or updated by manufacturers, distributors or other legitimate sources. Where a material error is identified, we may correct the information and, where appropriate, contact affected customers before fulfilment.
Some products may have manufacturer instructions, safety notices, age restrictions or other use conditions. Customers should read and follow applicable product instructions and warnings.
6. Orders and contract formation
When you place an order, you are submitting a request to purchase the selected products at the displayed price, subject to these Terms and the availability of the products.
An automated order acknowledgement or receipt confirms that the order information has been received. It does not necessarily mean that the order has been finally accepted for fulfilment. LITAVHA may need to verify payment, stock, pricing, delivery information and other order details before fulfilment.
A contract of sale is formed when LITAVHA accepts the order for fulfilment, subject to applicable law. Where an order cannot be fulfilled, we will communicate the relevant reason where appropriate and refund amounts paid for products that cannot be supplied, subject to the customer's statutory rights.
We may cancel an order where required by law, where payment cannot be verified, where a product is unavailable, where there is a genuine pricing or catalogue error, where fraud or abuse is reasonably suspected, or where fulfilment is otherwise not reasonably possible. Any cancellation will be handled in accordance with applicable law and our Refund, Returns & Cancellation Policy.
7. Pricing, taxes and promotions
Prices displayed on LITAVHA are stated in South African Rand unless otherwise indicated. Applicable VAT and other legally required charges will be presented as required by law. Delivery, handling or other charges may apply and will be disclosed before completion of an order where applicable.
We take reasonable care to maintain accurate pricing, but occasional technical, typographical or catalogue errors may occur. If a material pricing error is discovered, we may contact you with the correct information before fulfilment or cancel and refund the affected order where appropriate.
Promotions, discounts, vouchers and special offers may have their own conditions, eligibility requirements, validity periods, product exclusions or usage limits. Where promotional terms conflict with these Terms, the specific promotion terms will apply to the extent of the conflict.
8. Payment
Payment must be made using an available payment method presented during checkout. Payment processing may be performed by third-party payment providers. Your use of a payment provider may also be subject to that provider's own terms and policies.
LITAVHA may delay or stop fulfilment until payment has been successfully authorised or confirmed. We do not intentionally request customers to disclose payment-card PINs, online-banking passwords or other secret authentication credentials through ordinary customer-support channels.
9. Delivery and risk
We aim to dispatch and deliver orders within the estimated timeframes shown during checkout or in subsequent delivery communications. Delivery estimates are not guarantees where circumstances outside our reasonable control affect the courier or fulfilment process.
Delivery may be carried out by independent courier, collection-point or logistics providers. Customers are responsible for providing a sufficiently accurate delivery address and contact details and for taking reasonable steps to receive the order.
Where an order is delayed, lost, damaged or otherwise affected in transit, LITAVHA will work with the relevant logistics provider and customer to investigate and resolve the issue in accordance with applicable law and our refund/returns policy.
10. Returns, refunds and cancellations
Returns, refunds, exchanges and cancellations are governed by the Refund, Returns & Cancellation Policy, which forms part of these Terms.
Nothing in that policy or these Terms removes statutory consumer rights. Depending on the circumstances, a customer may have rights relating to defective goods, unsuitable goods, goods that are not as described, cooling-off periods for qualifying transactions, cancellations, refunds or other remedies under South African law.
11. Quality, defects and warranties
Products are supplied subject to applicable statutory consumer protections and any applicable manufacturer or supplier warranty. Where a product is defective or does not meet applicable legal standards, customers should contact LITAVHA as soon as reasonably possible with the order details and a description of the problem.
Manufacturer warranties, where offered, may have additional procedures and exclusions. A manufacturer's warranty does not remove statutory rights that cannot lawfully be excluded.
12. Reviews, comments and customer content
If LITAVHA allows customers to submit reviews, ratings, photographs, comments, questions or other content, you must ensure that your submission is lawful, truthful to the best of your knowledge and does not infringe another person's rights.
You must not submit content that is unlawful, threatening, defamatory, discriminatory, fraudulent, invasive of privacy, sexually explicit, malicious, misleading, or that contains malware, unsolicited advertising or other prohibited material.
By submitting content, you grant LITAVHA a non-exclusive, royalty-free, worldwide permission to host, reproduce, display and use that content for operating, improving and promoting the relevant LITAVHA service, subject to applicable law and our Privacy & POPIA Policy. You should not submit confidential information or another person's personal information without a lawful basis or permission.
13. Intellectual property
Unless otherwise stated, the LITAVHA website, branding, logos, page design, text, graphics, photographs, software, databases and other original materials are owned by or licensed to DASLEY SENTINEL SERVICES (PTY) LTD or the relevant rights holder and are protected by applicable intellectual-property laws.
You may access and use website content for ordinary personal shopping purposes. You may not reproduce, modify, distribute, sell, publish, create derivative works from or commercially exploit protected LITAVHA content without permission, except to the extent permitted by law.
14. Third-party services and links
LITAVHA may use or link to third-party services such as payment providers, courier services, hosting providers, communication platforms, analytics tools or other service providers. Those services may have separate terms and privacy notices.
A link to a third-party website does not necessarily mean that LITAVHA endorses or guarantees that website, product or service. We are not responsible for independent third-party services except to the extent responsibility is imposed by applicable law.
15. Security and prohibited conduct
You must not attempt to bypass security controls, interfere with website availability, introduce malicious code, access another person's account, probe systems without authorisation, use stolen payment information, submit fraudulent orders, abuse promotions, or otherwise misuse LITAVHA.
We may investigate suspected fraud, abuse or security incidents and may take reasonable steps to protect customers, payment systems, delivery operations and the website. Where legally required, information may be disclosed to law-enforcement or regulatory authorities.
16. Website availability and limitation of liability
We aim to keep the LITAVHA website and services reliable and available, but the internet and online services cannot be guaranteed to operate continuously or without errors. Maintenance, updates, security measures, technical faults, third-party outages and other circumstances may temporarily affect availability.
To the maximum extent permitted by law, LITAVHA is not responsible for losses that are not reasonably foreseeable or that are not caused by a breach of an obligation owed by LITAVHA. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot lawfully be excluded under consumer-protection legislation.
17. Events beyond reasonable control
LITAVHA will not be responsible for delay or failure caused by events outside its reasonable control, such as severe weather, natural disasters, infrastructure failures, internet or telecommunications outages, strikes, civil disturbances, government restrictions, supplier disruption, courier disruption or other comparable events. This does not remove any consumer right to a remedy that applies under law where goods or services cannot reasonably be supplied.
18. Complaints and disputes
If you have a question or complaint, please contact LITAVHA first so that we can investigate and attempt to resolve the matter. Please provide your name, order number where applicable, contact details and a clear description of the issue.
Nothing in these Terms prevents a consumer from exercising a statutory right, approaching a competent consumer-protection body or regulator, or using another lawful dispute-resolution mechanism available to that consumer.
19. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of South Africa, subject to mandatory consumer-protection and other applicable legal provisions. Any dispute will be dealt with by a court or other competent forum with jurisdiction, without unlawfully restricting any consumer's right to approach a competent forum.
20. Changes, severability and waiver
We may update these Terms from time to time to reflect changes to the website, products, services, business practices or applicable law. The latest version will be published on this page with its effective date. Changes will not retrospectively remove rights that have already accrued or otherwise operate contrary to applicable law.
If any provision is found to be invalid or unenforceable, it will be severed or read down only to the extent necessary, and the remaining provisions will continue to operate. A failure by LITAVHA to enforce a provision immediately does not necessarily mean that the provision is waived.
